Neighbors of 59 Queen, worried that a new two-story building would mar their sunlight, pleaded with the city’s Board of Zoning Appeals on Tuesday to reconsider the board’s approval of the home last month.
“There are points we feel like were not seriously considered,” said Edward Hamby, owner of 61 Queen St. “They weren’t heard.”
But acting chair Sam Altman, who was the sole voice against approval, said the neighbors were given fair time at the first hearing to present their case and new information couldn’t be accepted.
“When you bring up new points, what you are doing is trying the case all over again,” Altman told Hamby. “I voted for you because it was the right thing to do. Sitting as chair here, I have to tell you no, because that’s what the rules are.”
The board denied the appeal, but it sounds like this isn’t over. “We decided to represent ourselves instead of our attorney,” Hamby said of Tuesday’s failed request. “That’s going to be the next stage.” —Greg Hambrick
